End User Licence Agreement (EULA)

The licence terms for installing and using the GridTree desktop application, including restrictions, updates, and warranty disclaimer.

This End User Licence Agreement ("EULA") is a legally binding agreement between you and Flybring IT AB (org.nr. 559400-4318) ("Flybring IT", "we", "our", or "us") governing your use of the GridTree desktop application (the "Application"). Please read this EULA carefully before downloading, installing, or using the Application.

By installing or using the Application you agree to be bound by this EULA. If you do not agree, do not install or use the Application. This EULA should be read together with the GridTree Terms of Service (gridtree.app/terms) and Privacy Policy (gridtree.app/privacy), which are incorporated by reference.

Subject to your compliance with this EULA and the Terms of Service, Flybring IT grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to:

The Application is licensed, not sold. Flybring IT AB retains all right, title, and interest in and to the Application, including all intellectual property rights therein. You acquire no ownership interest in the Application by virtue of this EULA. All rights not expressly granted to you are reserved by Flybring IT.

4. Updates and Upgrades

Flybring IT may from time to time release updates, patches, or new versions of the Application ("Updates"). Updates may be delivered automatically or may require manual installation. This EULA applies to all Updates unless a separate licence agreement accompanies an Update, in which case that separate agreement governs. You agree to install security-critical Updates promptly. We reserve the right to discontinue support for older versions of the Application.

5. Subscription Requirement

Certain features of the Application require an active paid subscription through the GridTree web platform at gridtree.app. If your subscription expires or is cancelled, those features will become inaccessible until a valid subscription is reinstated. We are not liable for any loss resulting from feature unavailability due to a lapsed subscription.

6. Third-Party Components

The Application may include open-source software components that are governed by their respective licences. A list of third-party components and their licences is available within the Application. Your use of any third-party component is subject to its applicable licence terms, which take precedence over this EULA with respect to those components.

7. Internet Connectivity

The Application requires periodic internet connectivity to verify your licence and receive Updates. Features requiring connectivity will not function without it. We are not responsible for failures caused by your internet connection or network conditions.

8. Data Collected by the Application

The Application does not currently collect or transmit analytics or telemetry data (such as crash reports, performance metrics, or feature usage statistics). The Application connects to our servers only to verify your licence and to check for Updates; in doing so, standard technical data (such as your IP address, Application version, and licence identifier) is processed as described in our Privacy Policy at gridtree.app/privacy.

If a future Update introduces diagnostic or usage data collection, we will inform you in advance and, where required by law, obtain your consent before any such data is collected.

9. Disclaimer of Warranties

TO THE EXTENT PERMITTED BY APPLICABLE LAW, THE APPLICATION IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. FLYBRING IT DOES NOT WARRANT THAT THE APPLICATION WILL MEET YOUR REQUIREMENTS, OPERATE WITHOUT INTERRUPTION, OR BE FREE FROM ERRORS OR DEFECTS. YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE APPLICATION.

Nothing in this section limits any statutory guarantees that cannot be excluded under applicable Swedish or EU consumer protection law.

10. Limitation of Liability

TO THE EXTENT PERMITTED BY APPLICABLE LAW, FLYBRING IT'S TOTAL AGGREGATE LIABILITY UNDER OR IN CONNECTION WITH THIS EULA IS LIMITED TO THE GREATER OF (A) THE AMOUNTS YOU PAID TO FLYBRING IT IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) EUR 100. IN NO EVENT WILL FLYBRING IT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, LOSS OF PROFITS, LOSS OF DATA, OR BUSINESS INTERRUPTION, HOWEVER CAUSED.

These limitations do not apply to liability for death or personal injury caused by negligence, gross negligence or wilful misconduct, fraud, or any liability that cannot be excluded by law. If you are a consumer, these limitations apply only to the extent permitted by mandatory consumer protection law and do not affect your statutory rights.

11. Term and Termination

This EULA is effective from the date you first install the Application and continues until terminated.

Termination by you. You may terminate this EULA at any time by uninstalling and deleting all copies of the Application from your devices.

Termination by Flybring IT. We may terminate this EULA immediately if you breach any of its terms, or if your subscription is cancelled or terminated. We may also discontinue the Application with at least 30 days' notice.

Effect of termination. Upon termination, the licence granted under this EULA ends immediately, and you must uninstall and destroy all copies of the Application in your possession. Note that uninstalling the Application may leave behind local user data and settings files stored on your device (such as application preferences and configuration). These files are not transmitted to Flybring IT and remain solely on your device; you are responsible for removing them manually if desired. Sections 2, 3, 9, 10, 12, 13, and 14 survive termination.

12. Export Control

The Application may be subject to Swedish, EU, and international export control laws and regulations. You agree not to export, re-export, or transfer the Application in violation of any applicable export laws, including to any country subject to a trade embargo or to any person on a restricted party list.

13. Governing Law and Disputes

This EULA is governed by the laws of Sweden. Any dispute arising out of or in connection with this EULA shall be subject to the exclusive jurisdiction of the Swedish courts, with the District Court of Ångermanland (Ångermanlands tingsrätt) as the court of first instance, unless mandatory consumer protection laws in your country of residence require otherwise.

If you are a consumer in the EU, you may also refer disputes to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN) at www.arn.se.

14. General

Entire agreement. This EULA, together with the Terms of Service and Privacy Policy, constitutes the entire agreement between you and Flybring IT with respect to the Application.

Severability. If any provision of this EULA is held to be invalid or unenforceable, the remaining provisions remain in full force and effect.

No waiver. Failure by Flybring IT to enforce any provision of this EULA does not constitute a waiver of the right to enforce it in the future.

Assignment. You may not assign or transfer your rights under this EULA. Flybring IT may assign its rights freely.

Language. This EULA is written in English. In case of any conflict with a translated version, the English version prevails.
